Is temple of kings glitches?

I was farming yugi and I was trying to go for my last turn kill. I had vassal, mystical serket, and unhappy girl. Temple of king won't let me tribute my serket for blue eye ultimate. This problem does not occur when I have two monster. However it occur when I have 3 monster.

You can only use ToK's effect if you have at least one monster in your hand or deck. That's why it's better to either save a monster in your hand or use ToK's effect on your second to last turn. Annoying, I know
