If you got the trap card Eternal Galaxy from the same box you can summon it easily. Though I don't think it allows you to use its negate ability.

no, it wouldn't be an issue only if the OP actually wants to build a Photon deck.

Anyone who don't have enough good cards to summon NGEPD likely never wanted to build NGEPD deck in the first place.
